11. DEFINITIONS


The terms used in this Personal Data Protection Policy, whether in the singular or plural form, have the following meanings:
"Client": refers to any person who has subscribed to the services provided by IFW.
"Website" (or "Site", depending on the context): refers to the IFW website, accessible at the url https://intimatefrenchwedding.com, including all its components and contents.
"Personal Data" (or "Data" depending on the context): refers, according to Article 4 of Regulation (EU) 2016/679 of April 27, 2016, to any information relating to an identified or identifiable natural person (referred to as the "data subject" in this text). An "identifiable natural person" is considered to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more specific elements specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.
"Privacy Policy" or "Policy", depending on the context: has the meaning given to this term in Article 1 above.
"Applicable Regulations": refers to Regulation (EU) 2016/679 of April 27, 2016 (known as the "General Data Protection Regulation" or "GDPR") and the French Data Protection Act of January 6, 1978, as amended (known as the "Data Protection Act" or "DPA").
"Processing", "Data Controller", "Data Processor": have the definitions given to each by Article 4 of Regulation (EU) 2016/679 of April 27, 2016.
"User": refers to any natural person accessing the Site, on their own behalf or on behalf of a third party, whether they are a simple User, Client, or prospect..


This Policy is subject to updates or other modifications. It may be amended based on changes in applicable Regulations and recommendations from the European Data Protection Committee (EDPC). Users are recommended to regularly review it. Any new version posted online is immediately binding upon the User. The use of the Site is subject to the Policy in effect at the time of use.

If any provision of this Policy is deemed null or unenforceable by a court or any other competent authority, it shall not affect, to the fullest extent permitted by law, the validity or enforceability of its other provisions, which shall remain in effect and fully enforceable.

IFW ensures the protection and security of processed Data and has implemented necessary physical, electronic, and organizational measures to prevent any loss, misuse, damage, destruction, or unauthorized disclosure of the processed Data.

9. SECURITY MEASURES


Who uses cookies?
The information that IFW collects through cookies is only used by IFW, its employees, and its partners responsible for managing and administering the Site.

How is the handling of cookies accepted by the User?
In accordance with applicable regulations, IFW obtains the User's consent before storing non-essential cookies. By declining this consent, the User can still access the Site, but certain functions may be limited. 8.COOKIES


In order to provide its services, IFW may use service providers located outside of the European Union. In this context, a transfer of User Data may occur to a third country where the legislation has not been recognized as offering an adequate level of protection for Personal Data.

7.PERSONAL DATA TRANSFERS


In accordance with the applicable Regulation, every User has the rights listed below regarding their Personal Data:

- The right to rectify, update, and complete personal data (Art. 16 of the GDPR);
-The right to erasure (or "right to be forgotten") of personal data of Users when: (i) they are no longer necessary for the purposes of their Processing, (ii) the User has withdrawn their consent, (iii) the User objects to their Processing, (iv) the Processing is unlawful, (v) the Data must be erased to comply with a legal obligation (Art. 17 of the GDPR); 
-The right of access, which allows for the identification of processed Data and obtaining a copy of it (Art. 15 of the GDPR);
 -A right to data portability, when the Data is subject to automated processing based on the User's consent or the performance of a contract, and said processing is carried out using automated means (Art. 20 of the GDPR);
-A right to data processing limitation, allowing the User to obtain the restriction of their personal data processing under the conditions of Article 18 of the GDPR, except in cases where the processing is based on a legal obligation. When processing is necessary for the performance of a contract or pre-contractual measures, IFW will not be able to fulfill said contract or measures in case of processing limitation;

A right to object to Data Processing allows the User to oppose, at any time and for reasons related to their specific situation, the processing of their personal data, as defined in Article 21 of the GDPR. This right does not apply when processing is based on a legal obligation. When processing is necessary for the performance of a contract or pre-contractual measures, IFW will be unable to execute said contract or measures if there is an objection to the processing of personal data.

-The right to withdraw consent allows the User to withdraw their consent to the processing of their Data if such Processing is based on consent. The withdrawal of this consent does not affect the lawfulness of the consent-based processing carried out prior to its withdrawal.
-The right not to be subject to an individual automated decision (including profiling).
-The right to transmit instructions to IFW regarding the exercise of the aforementioned rights and the use of their data after their death.
To exercise the aforementioned rights, the User must submit their request to IFW via:

Any request made by the User under the aforementioned conditions must be accompanied by (i) proof of identity and (ii) indicate the address to which the response to the request should be communicated.
For any information request or complaint, the User can also contact the National Commission on Informatics and Liberty (CNIL) or any other competent authority. However, the User is invited to contact IFW prior to any complaint to the CNIL, whose contact details are provided below:

6.USER RIGHTS ON DATA

Access to Data is strictly limited to authorized IFW employees and agents due to their roles and responsibilities.
Data may be shared with technical service providers and/or subcontractors contracted to perform necessary tasks for the proper functioning of the Site and its services, as well as for the effective management of the relationship between the User and IFW, without the User's need for authorization. Any subcontractors have limited access to the Data and are contractually bound by applicable Regulations.

5. DATA RECIPIENTS

IFW retains User Data for the duration necessary to achieve the purposes described in Article 2 above, plus the duration of applicable legal prescription periods.
As a result:
- Customer Data is kept for the entire duration of the pre-contractual and/or contractual relationship, as well as for the duration of the applicable prescription period (which is five (5) years under general law and two (2) years for consumer disputes).
- Prospect Data and Data for commercial prospecting purposes (newsletter) are retained for a period of three (3) years after the last contact with the individual concerned.
- Any inquiries or questions regarding the Site and IFW services are kept for the duration necessary for their processing.
- Accounting Data is retained for ten (10) years from the closing of the accounting period.
Upon expiration of the aforementioned periods, User Data is permanently deleted or anonymized.

4. DATA RETENTION DURATION

The categories of Data subject to Processing implemented by IFW (as described in Article 2 above) may include:
- Identity Data provided by the User:
(1) in the "Contact" form on the Website, namely: name, first name, email address, phone number, country of residence, estimated date of the wedding, estimated number of guests, estimated wedding budget, and desired event location;
(2) in case of subscription to the "Intimate French Wedding Diary" newsletter on the Website: first name and email address;
(3) when establishing contractual documents, as well as for invoicing, recovery, and archiving of invoices: name, first name, date of birth, home address, phone number, and email address;
(4) in the context of written or telephone exchanges between the User and IFW: any information voluntarily provided by the User during their contact, request, and/or during the performance of contractual services;
- User relationship tracking data;
- Website browsing data (see Article 8 on Cookies).

3. Categories of personal data processed

1.DATA CONTROLLER

IFW implements Processing (terms starting with a capital letter are defined in Article 11 below) of Personal Data of Users for the provision of services offered on its Website.
In this context, IFW takes care to comply with the applicable Regulations on the protection of personal data. As the Controller of the processing, IFW implements adequate measures to ensure the protection, confidentiality, and security of Users' Personal Data, as well as to process and use this Data in compliance with the applicable Regulations.
This privacy policy (hereinafter referred to as "Privacy Policy" or "Policy," as applicable) aims to inform Users about how IFW processes their Data. It is provided to Users, who can access it on the Website and must read it.

2.PURPOSES AND LEGAL BASIS FOR THE PROCESSING OF DATA

The Data Processing carried out by IFW has the following purposes:
- The operations of receiving, managing, processing, and monitoring contact requests and inquiries made by Users via:
(i) the "Contact" form on the Website;
(ii) the subscription form for the newsletter "Intimate French Wedding Diary" on the Website;
(iii) email; and/or
(iv) any telephone exchange between IFW and a User.
The sending (subject to subscription and no objection from the User) of newsletters.
These Treatments (as listed above) are based on the legitimate interest of IFW (while respecting the fundamental freedoms and rights of Users) in the operations indicated to meet User requests and promote its services, enhance quality, and grow its business;
- Managing contract conclusion;
-Executing services provided by IFW within the contractual relationship;
-Managing billing, payment, and accounting;
-Monitoring the contractual relationship with Clients;
-Handling potential complaints, as well as any requests, orders, or judgments of a judicial or administrative authority;
-Processing and monitoring Users' requests to exercise their rights under applicable data protection regulations;
- Ensuring IFW's compliance with accounting and tax obligations.
These Treatments (as listed above) are based on legal grounds, including the performance of the contract (including, but not limited to, the performance of pre-contractual measures) or compliance with legal obligations.
